Speeding Violation
Speeding in violation of N. J. S. A. 39:4-98 is one of the most commonly cited motor vehicle infractions. A speeding conviction can carry very serious consequences. A driver found guilty of speeding will be fined from $50 to $200, and if the Court feels it is warranted, a jail term of up to 15 days can also be imposed. The extent to which the speed exceeded the posted speed limit can impact the penalty since the fine for traveling 20 MPH or more over the posted speed limit is double the amount specified by law. The Court also has the power to suspend an operator's driving privileges for a speeding violation, or for any moving motor vehicle violation, if the Court finds that the offending conduct was "willful." The Motor Vehicle Commission (MVC), formerly known as the Department of Motor Vehicles (DMV), will assess penalty points for a speeding conviction and the driver's insurance company will assess insurance eligibility points. Such evidence must be supported by, among other things, proof that the patrol car's speedometer was accurate.
