A driver on a multi-lane road in New Jersey must, in compliance with N. J. S. A. 39:4-88, normally drive in the right lane when the lane is available for travel except when passing or in preparation for a left turn. The vehicle must also be driven as nearly as practicable entirely within a single lane, and may not be driven from that lane until the driver determines that it can be moved safely. The statute also restricts when a vehicle may be driven in the center lane on a three lane road, and when certain trucks may be driven in the far left lane on a roadway with three or more lanes. Violations of the statute are generally termed Failure To Keep To The Right or Failure To Maintain Lane.

A driver violating this statute will be fined from $50 to $200, and the Motor Vehicle Commission (MVC), formerly known as the Department of Motor Vehicles (DMV), will assess two motor vehicle points and the driver's insurance company will assess two insurance eligibility points. The fine will be doubled if the violation occurs in a construction zone or safe corridor zone, or in a 65 MPH speed zone. The Court also has the authority to impose a 15 day jail sentence.
