The law applies to both front and back seat passengers, and makes the driver responsible for ensuring any minor passenger is wearing a belt. A child younger than 8 and weighing less than 80 lbs. is required to ride in child passenger restraint system or booster seat. Any passengers located anywhere in the vehicle between the ages of 8 and 18 must also wear a seat belt. The failure to wear a seat belt is a traffic violation that will result in a fine and payment of court costs. If you fail to pay your fine or appear in court, a warrant can be issued for your arrest.
